PUBLIC STATEMENT OF THE UHLAND ECONOMIC DEVELOPMENT CORPORATION

In 2024, the Uhland Economic Development Corporation (“Uhland EDC”) approved various agreements, including a ground lease and performance agreement with Old Town Uhland, LLC, relating to a project for the operation of the Uhland Fall Festival on approximately 98 acres of land still currently owned by the Uhland EDC.

Projects involving the leasing of EDC-owned property and the provision of economic development incentives are generally authorized under Chapter 505 of the Texas Local Government Code when approved by an EDC board of directors and based on a determination that the project promotes new or expanded business development for the City.

The Uhland EDC has recently become aware of public allegations questioning whether all applicable statutory procedures were followed in connection with the approval of the above-referenced agreements. Because these matters involve events that occurred in the past and include multiple meetings, participants, and legal considerations, the Board has directed its current legal counsel to conduct a review of the circumstances surrounding the approval of the agreements and to advise the Board regarding the Uhland EDC’s legal rights, obligations, and available options.

The Board recognizes the seriousness of the concerns that have been raised. However, it would be premature to comment further until the review is complete and the Board has a full understanding of the relevant facts and legal considerations. The Uhland EDC appreciates the public’s patience as it undertakes this process and works toward an informed decision regarding the future of the existing project.
